Legal framework & operation of Lunaya Travel
Transparency about our role
At Lunaya Travel, we want to clearly explain how we operate to ensure a transparent relationship with our travellers, partners, and visitors.
Our aim is to offer a more human, more flexible and more local approach to travel in Thailand, while clarifying the legal framework within which we operate.
Our role
Lunaya Travel acts as:
- an independent platform for connecting,
- A travel concierge,
- a stay facilitator,
- a curator of local experiences,
- a coordinator between travellers and independent providers.
We select, recommend, and facilitate access to select experiences, activities, excursions, retreats, or services offered by independent local partners in Thailand.
Lunaya Travel is not a traditional tour operator
Unless explicitly stated otherwise for certain specific services, Lunaya Travel does not operate as a traditional tour operator in the sense of European regulations on package holidays.
This means that Lunaya Travel, among other things:
- does not offer all the activities proposed,
- does not operate excursions directly,
- does not directly provide transport,
- does not directly employ independent local guides,
- does not directly operate partner boats, vehicles, hotels, or infrastructure.
We primarily facilitate the connection and coordination between travellers and the relevant local service providers.
How benefits work
The experiences offered via Lunaya Travel are carried out by independent local operators, guides, captains, drivers, activity centres, accommodations or partners.
Each partner remains responsible:
- of his performance,
- of its authorisations,
- of its licences,
- of his insurances,
- of its employees,
- of his equipment,
- of compliance with applicable local regulations.
The services can be carried out by:
- local companies,
- independent guides,
- approved tourism providers,
- maritime operators,
- partner centres.
Responsibilities of service providers
Responsibility for the delivery of services lies directly with the relevant operators.
This includes, but is not limited to:
- Safety of activities,
- the supervision of participants,
- the weather conditions,
- maritime navigation,
- transport,
- professional insurance,
- any potential changes to routes,
- operational decisions taken on the ground.
Each partner operator acts under their own legal and professional responsibility.
Assurances
The insurance related to the activities is managed by the respective operators and providers, according to their own legal framework and local obligations.
Lunaya Travel does not automatically provide personal travel insurance to travellers.
We strongly recommend that every client takes out:
- travel insurance,
- medical insurance,
- an accident insurance,
- cancellation insurance,
- travel insurance suitable for their stay.
Coordination and assistance
Even though Lunaya Travel does not act as a direct operator, we aim to:
- facilitate exchanges,
- Support travellers before their stay,
- coordinate some bookings,
- to help organise the overall experience,
- to direct clients to selected partners according to our own criteria.
We favour partners:
- premises,
- experienced,
- reliable,
- recognised,
- and selected based on our field experience.
Limitation of liability
Lunaya Travel acts primarily as an independent intermediary for connections and coordination.
Accordingly, Lunaya Travel shall not be held liable:
- acts or omissions of independent contractors,
- accidents or incidents that occurred during activities,
- delays,
- Cancellations due to weather conditions,
- government decisions,
- force majeure events,
- loss or damage related to services performed by third parties.
Any claim relating to the performance of an activity must be addressed to the operator concerned in the first instance.
Acceptance of terms
When booking an activity or using the services offered via Lunaya Travel, the traveller acknowledges that they have read and understood:
- of the role of Lunaya Travel,
- of the functioning of benefits,
- from the framework of bringing together,
- as well as this legal information.
